text-indent: 2em; line-height: 2em; visibility: visible;'><span leaf="" style='visibility: visible;'><br></span></p><p style='color: rgba(0, 0, 0, 0.9); text-indent: 2em; line-height: 2em; visibility: visible;'><span leaf="" mpa-font-style='mhfsyj3q7oi' style='visibility: visible;'><span textstyle='' style='letter-spacing: 1px;'>2025年4月，咸宁市嘉鱼县市场监督管理局网络交易股工作人员在对平台餐饮服务商户监测过程中，发现某店铺公示的《营业执照》已注销。执法人员通过现场核查和线上检查，发现当事人存在“食品经营许可等信息发生变更未及时于外卖平台更新、在网上公示的餐饮服务提供者的名称不真实”的违法行为，违反了《网络餐饮服务食品安全监督管理办法》第九条、第十条的规定。依据《网络餐饮服务食品安全监督管理办法》第三十二条和《市场监督管理行政处罚裁量规则》第十一条第二项规定，对其作出警告的处罚。</span></span></p><p style='color: rgba(0, 0, 0, 0.9); text-indent: 2em; line-height: 2em; visibility: visible;'><span leaf="" style='visibility: visible;'><br></span></p><p style='color: rgba(0, 0, 0, 0.9); text-indent: 2em; line-height: 2em; visibility: visible;'><span leaf="" mpa-font-style='mhfsyj3qbz8' style='visibility: visible;'><span textstyle='' style='letter-spacing: 1px;'>2025年4月，孝感市市场监管局执法支队执法人员根据案件线索对某餐饮店进行现场检查，发现当事人提供给顾客的菜单上有“凉拌牛肉”冷荤凉菜售卖，食品经营许可证上无“冷食类食品制售”项目，且无凉菜专间。检查时，当事人制售的“凉拌牛肉”菜品已从外卖平台下架。当事人未取得食品经营许可项目：“冷食类食品制售”在网络平台销售冷荤凉菜的行为，违反了《网络食品安全违法行为查处办法》第十六条第一款的规定，依据《网络食品安全违法行为查处办法》第三十八条的规定和《中华人民共和国食品安全法》第一百二十二条第一款的规定，对当事人作出没收违法所得、罚款的行政处罚。</span></span></p><p style='color: rgba(0, 0, 0, 0.9); text-indent: 2em; line-height: 2em;'><span leaf="" mpa-font-style='mhfsyj3q152a'><span textstyle='' style='letter-spacing: 1px;'>2025年5月，仙桃市局执法人员对某餐饮外卖店进行现场检查，在店内二楼冰柜内发现一袋手工粉超过保质期，执法人员对上述湿米粉予以扣押并立案调查。经查，当事人存在采购食品未履行进货查验义务、使用超过保质期食品的行为，违反了《中华人民共和国食品安全法》第五十三条第一款、第三十四条第一款第三项规定。根据《中华人民共和国食品安全法》第一百二十四条第一款第二项、第一百二十六条第一款第（三）项规定，对当事人给予警告、没收超过保质期的1包湿米粉、罚款的行政处罚。</span></span></p><p style='color: rgba(0, 0, 0, 0.9); text-indent: 2em; line-height: 2em;'><span leaf=""><br></span></p><p style='color: rgba(0, 0, 0, 0.9); text-indent: 2em; line-height: 2em;'><span leaf="" mpa-font-style='mhfsyj3q1hp3'><span textstyle='' style='letter-spacing: 1px;'>2025年5月，掇刀区执法人员根据举报线索对当事人的经营场所进行现场检查，发现当事人店铺摆放有12个成品蛋糕模型，蛋糕模型表面均使用了皇冠、卡通玩具和字形卡片等装饰品与食品直接接触，且现场还发现了大量同类型未使用的装饰品。当事人的行为违反了《中华人民共和国食品安全法》第五十条第一款规定，依据《中华人民共和国食品安全法》第一百二十五条第一款第（四）项的规定，责令当事人改正违法行为，并综合考虑当事人的违法事实、情节、性质和社会危害后果，按照过罚相当、处罚与教育相结合的原则，对当事人予以减轻处罚，作出没收违法所得、罚款的行政处罚。</span></span></p><p style='color: rgba(0, 0, 0, 0.9);
