max-width: 100%; letter-spacing: 0.544px; visibility: visible; box-sizing: border-box !important;'><p><span leaf="">“侥幸心理让我们一步步滑向深渊，我们愧对组织，愧对人民……”近日，由仙桃市检察院提起公诉的一起非法获取计算机信息系统数据罪暨刑事附带民事公益诉讼案在仙桃市法院开庭审理，被告人朱某某、许某当庭认罪悔过。</span></p><p><span leaf=""><br></span></p><p><span leaf="">时间回溯至今年3月，被告人许某主动联系被告人朱某某，提议由朱某某利用其身份便利，将履行职务过程中获取到的公民个人信息发给他人，许某再以每条10至13元的价格与对方进行结算，获利由二人平分，截止案发前两人共非法获利两万余元。</span></p><p><span leaf=""><br></span></p><p><span leaf="">两名被告人违反国家规定，侵入计算机信息系统，获取该计算机系统中存储的数据，又将数据售出，其行为违反了《民法典》第一千零三十三条之规定，致使众多不特定人员的信息长期面临受侵害的风险，严重侵害公民个人信息安全，损害社会公共利益，根据第一千一百八十二条之规定，应按照获利金额承担赔偿责任。</span></p><p><span leaf=""><br></span></p><section style='text-align: center; margin-right: 8px; margin-left: 8px; visibility: visible;'></section><p><span leaf=""><br></span></p><p><span leaf="">庭上，市检察院以非法获取计算机信息系统数据罪，依法对朱某某、许某提起刑事诉讼及附带民事公益诉讼，在追究刑事责任的同时，要求两名被告人就侵害公民个人信息的行为支付六万余元的公共利益损害赔偿金，并在市级以上新闻媒体就侵犯公民个人信息事宜向公众公开赔礼道歉。</span></p><p><span leaf=""><br></span></p><p><span leaf="">庭审中，检察机关围绕犯罪事实，紧扣犯罪构成，从案件证据、法律责任以及社会危害性等方面综合分析，发表了公诉意见和公益诉讼起诉意见。两名被告人对检察机关指控的犯罪事实均无异议，当庭表示认罪悔罪，并愿意承担相应的民事赔偿责任，向社会公众公开道歉。</span></p><p><span leaf=""><br></span></p><p><span leaf="">“此类案件中，个人信息泄露往往引发电信诈骗、精准骚扰等连锁危害，影响范围广、修复难度大。”承办检察官介绍，检察机关通过刑事附带民事公益诉讼的方式，既以刑事处罚震慑违法犯罪，又以民事追责填补公益损害，通过支付赔偿金、公开赔礼道歉等方式形成社会警示，强化个人信息安全管理。</span></p><p data-pm-slice="0 0 []"><br></p></section></section></section></section></section></section></section></section></section></section></section><section data-role="outer" label="edit by 135editor" style='-webkit-tap-highlight-color: transparent;
